I paid a substantial retainer fee to Todd Tracy, who assured me at the time that if he was conflicted out of our case I would be immediately refunded any unused portion of the retainer. I am a widow and the fee was paid from the death benefit I received from husband. I could not really afford to do this, but it is an important matter and I had no other way to satisfy his specific payment requirement.
After a very poor performance, allowing $200,000 to be seized from our business, Mr. Tracy was indeed conflicted out of our case and is not authorized to bill any more hours. Naturally, I requested from him the return of my remaining funds, which he initially told me he would return to me. When I came to his office at the appointed time to pick up the promised check, I was kept waiting by him for over an hour, only to have him inform me that he would not release my funds to me.
