Mr. Fogel grossly underestimated his billable hours. He had already charged this client almost half of his estimate (which he required as a retainer) before an engagement letter. His final bill (over 700% of what he had estimated) arrived two years after he was engaged. Mr. Fogel had indicated that his legal assistant would be doing most of the basic work and that clerical staff would be doing the clerical work. This was not true. He charged at his highest billing rate for clerical tasks such as sending faxes.
In addition, multiple errors were found in his work. He submitted documents to me that that he had prepared for another client, changing only the names and billing for several hours. Upon proofreading the document, it was found that he failed to change all of the names--violating the confidentiality of the previous client. He incorrectly prepared a real estate note payable. In overview, his service was judged to be expensive and far below standard.
