Attny Pelech knowingly participated in the sale of two properties for an individual who was bound by Family law 458-16b. Attny Pelech allowed one piece of property to be severely encumbered against the spouses wishes and without written approval from the spouse or the court. Mr. Pelech processed a sale of a second property. The spouse had disapproved in writing both the encumbrance of the property and the sale. There was no approval from the court for encumbrance or sale of the property. Nevertheless, Attny Pelech oversaw and completed the sale of the property. The funds were turned over to the husband. These funds were dissipated and were no longer available as a marital asset.
