Question in Issue, (Never Answered by SCC) Whether a trial judge, who was an ex-crown attorney / Attorney General of Province with the whole police force under her in the same court and has represented the interests of the crown and police for several years, incapable of making an impartial and independent judgment, due to perceived conflict of interest ? If so, does that court proceeding infringe on Section 11d of the Charter of Rights and Freedom ? If so, does that in effect quash any judgment by that trial judge / Attorney General in legal proceedings of that trial court ? Andromache Karakatsanis is NOT independent of Crown / Prosecution as she gets retirement benefits from the Crown Ref.
