The subject attorney represented an immigrant with conditional residency status and a mother of three minor children in a civil domestic violence matter. During the course of the case, the subject attorney allowed the client to testify -under penalty of perjury- to facts, facts that were not even relevant to the issue before the Court, that established all the elements of Welfare Fraud. The client is now under investigation for welfare fraud and the judicial record established by the attorney will allow any investigative agency to prove the fraud, all thanks to the apparent gross negligence of the attorney. The client is now in peril of criminal charges and deportation when this issue could have been kept off the record and mitigated.
