Marjorie Hickey represented the Nova Scotia Barristers’ Society in the disciplinary proceedings against Lyle Howe, including a 66-day hearing. NSBS cost submissions recorded more than $733,000 in fees and HST paid to McInnes Cooper for advice and representation in the matter. Hickey later wrote to Howe in May 2019 stating the Society’s position that it had not discriminated against him and would not resolve the matter with any admission of discrimination. Since then, NSBS has acknowledged systemic discrimination within the profession, accepted all 21 recommendations of the Ruck Report and apologized. In 2025, Human Rights Commission investigators recommended that two Howe complaints proceed to a Board of Inquiry. Those complaints were referred in January 2026. No Board of Inquiry finding of discrimination has yet been made, and NSBS is challenging the referral by judicial review.
