2020: I paid Mr. Sherman to confirm my opinion that a settlement proposal was enforceable; he agreed. A year later I again wrote and paid him in advance to email me about how to proceed at Family Court. He cashed my cheque but did not respond. I waited a month and wrote again; his clerk asked me to meet him but Sherman delayed the appointment for another 5 weeks. We met for 45 minutes and he (1) now said the settlement proposal was NOT enforceable (WTF?) (2) had no file nor took notes - asked again for basic info like what city I lived in (3) seemed listless and uninterested, (4) scoffed at a $10,000 retainer to start (5) erred in law saying a proposal to settle lacking "Without Prejudice" could not be put in evidence, erred in saying an application could not be brought in Hamilton for a home nearby, (7) said he would advise me in an email by a specified date, then never contacted me again. Have lawyers evolved to this at $350+/hr in the 20 years since I stopped practising law?

I was very disappointed with David's divisive approach to family law. David demonstrated an ability to create new problems that didn't exist in the first place. If you are looking for a collaborative approach to family law, keep looking because you won't find it here.

David handled my divorce and got me a very favourable result. However I warned him that my ex-wife would file for bankruptcy and he assured me that I would still get the monies owed to me. I only got my half of the house sale and David took all $55,000 of it. I retained him for another $2000 to chase down the monies owed, back support for my son and title to my cottage. He essentially did nothing for me in over two years and then finally told me that a new law precluded me from getting back support for my son. His inactivity cost me over $10000 in support. In court he's great but unless you are a big ticket case, he does nothing for you. He doesn't return calls, keep appointments or honour commitments to follow up on issues.

Mr. Sherman took a hefty retainer, and did not return any calls, emails. I had to report him to the upper law society of Canada, just to get my file back. It ceases to amaze me how some people can be so insensitive to others in such a difficult time of their lives.

He acted for me for almost 2 years either unavailable due to other trials or illness and on drugs. Unable to function and took 1.5 yrs to get a simple child support. Make sure your contract is in writing and check your bills as he does charge for talking to his assistant to get an appointment or ask why your there is no response to your question at his rate. Make sure you know what you are paying for all the time.
