Richard Polk was the attorney for my grandfather's estate and the trustee. I am not sure whether he was negligent, dishonest or incompetent, but if someone were to investigate his actions one of the foregoing would likely be revealed.
Over the course of my interaction, among other things,
- he was dismissive and abusive in communications;
- failed to provide statutorily required documents to beneficiaries in a timely manner;
- ignored filing deadlines;
- distributed funds in contravention of the trust documents;
- failed to provide proper accountings;
- failed to provide a retainer agreement;
- failed to provide an itemized billing, instead accounted for tens of thousands of dollars in fees in a single line item at the end of one year.
The greatest pain comes from knowing how my grandfather would react if he knew a person like Richard Polk was running roughshod over his wishes and the estate he worked so hard to build.
