Mr. Fishbein, and his associate, Robert Unterberger took my appeal for a med. mal. case. They did no interrogatories, depositions, no witness prep and had the wrong witness, pediatric and not adult.The appeals court retuned the case back for retrial calling defendant's testimony perjurious stating his 2 deposition testimonies was different from testimony at trial. On a Fri. Unterberger chose a jury then called me 7 times in a 2 1/2 hour period reducing an offered settlement amount each time. On the 7th call, crying, I told him do whatever to just stop it. I knew he was not ready for trial on Monday morning. I called Fishbein on Mon. and told him I did not accept the offer, Unterberger forced me to. Fishbein told me I had to, I had no choice.I found out much later Fishbein, while doing nothing on my case was the lead lawyer for Phen-fen, for that he was able to do the work necessary. He just wanted to get the most money for the least amt of work. The behavior was lazy and incompete
