Represented his former law partner in a lawsuit against me. Served me by publication in Jewish News, I’m Asian, then had his paralegal email me his application for default “for your records.” The deadline to respond to the default was the deadline for filing a Joint Report. The case was dismissed without prejudice for lack of prosecution. Five months after the Joint Report was due, he asked the judge to reinstate the case because it could be just be refiled and “but for” me avoiding service and not appearing until default was imminent, then filing a motion to dismiss, he would have met the deadline for filing a Joint Report. Refused to take any action for over two years to have nearly $10,000 of uncontested funds released to me. Whined to the judge that I was driving up his client’s fees when he was working on contingency. Routinely made arguments that transferred his burden of proof to me. Made numerous contradictory statements.
