3 strikes and he's out. The first time I had to hire him because I had no choice. The opposition's attorneys had spoken to, left messages for or otherwise made contact with every other attorney in town. The second time was an effort to have the first finding by the court reviewed. Failed on that. This time, I hired him on another matter because I perhaps unreasonably expected him to perform better than he did in the past. He knew he hadn't performed well in the past, and I thought he might be more motivated to prove himself to both himself and his partners. If all his partners evaluate him on is the money he brings to the firm, then he did pretty well since a lot of it was my money. However his results, in my experience, are repetitively and traumatically terrible.
