Incident occurred Worcester Court 12/14/09. Perpetrator: JOHN GOGGINS, Worcester MA attorney.
Goggins was re-working numbers with my lawyer, relative to pension payouts. My lawyer threw out a hypothetical scenario: "Let’s say my client retires at age 65 and lives to age 80…”, Goggins interrupted,: “You think this guy is going to make it to 80? LOOK at that POT BELLY!”
His comment was an attempt to speculate on my early demise based on what was a weight issue that was visually unsatisfactory to him.
It was a personal attack with mean-spirited intent.
In this age of racism & sexism, where we must be sensitive to all cultures/disabilities, I can’t let this go easily. I live with a chronic illness-- Diabetes, and as a result struggle with fluctuating weight.
MA Rules Of Professional Conduct guide, rule # 4.4 states, A lawyer shall not use means that have no substantial purpose than to embarrass, delay, or burden a third person. His statement clearly violates this.
