This lawyer withdrew (abandoned) from a case the day before the scheduled hearing. The client was charged with insuborination in the Fairfax County Va. school system. The pretext for his withdrawl was that the client did not have a defensible position. Consequently, the client was dismissed from an $80,000.00 yearly position. However, the Va. Employment Commission granted the employee unemployment benefits stating that the Va. Supreme Court had defined "insuborinatation" and that according to that definition the employee was not insuborinate. Also, the following case law fully supported the employee's position:Douglas v. Veterans Administration, 5 MSPB (Merit System Protection Board) 313 (1981) |
